2008 Summer of Savings
NO PURCHASE OR OBLIGATION NECESSARY. Non-purchase entries and purchase entries have an equal chance of winning.
Eligibility: The 2008 Summer of Savings Sweepstakes (the “Sweepstakes”) is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old at the time of entry and qualify as an owner or employee of an independent auto repair, collision or body shop facility (“Eligible businesses”). The following do not qualify as an independent auto repair, collision or body shop facility: franchised OEM new car dealer body shops and repair shops, fleet repair facilities, government agencies – repair facilities, independent used vehicle dealers, and auto auctions. Owners and/or employees of the following facilities are excluded from eligibility: (i) a facility that is a competitor of Ford Motor Company (“Sponsor”) and/or to Sponsor’s business segment; and/or (ii) a facility that is a competitor of any of the #21 Motorcraft® Fusion’s Sponsorship obligations or sponsors, associate sponsors, or paid advertisers. Sponsor shall determine eligibility in its sole discretion. Independent auto repair and body shops are those not affiliated with an OE manufacturer franchise. All others are specifically excluded from participation, including employees of Ford Motor Company, CCO Communications, Inc./dba PCGCampbell (“PCGCampbell”), and their parent and affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. Subject to all applicable federal, state, and local laws and regulations. Void where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.
To Enter: The Sweepstakes begins on April 1, 2008, at 12:00 a.m. Eastern Time ("ET") and ends on September 30, 2008, at 11:59 p.m. ET (the "Promotion Period").
Enter one of [2] ways: (1) Automatic Entry: Eligible businesses will automatically receive (1) entry for each valid rebate redeemed during the Promotion Period. Rebate books will be direct mailed to select businesses prior to April 1, 2008, and will also be available electronically. Eligible businesses can go to the Web site www.2008SummerofSavings.com and submit their information to download an electronic version of the rebate book. There are two rebate redemption periods: Qualifying I (April 1 – May 31, 2008) and Qualifying II (July 1 – August 31, 2008). There are ten (10) rebate offers in each period. Each eligible business is eligible to redeem one rebate per product per business per redemption period. The maximum number of rebate redemptions and sweepstakes entries is (20) for the promotion period. Specific rebate instructions can be found on the rebate offers. Rebate checks and Sweepstakes prizes will be issued in the business name in care of the business owner. Any employee of the eligible business can complete rebate requests. Employees will enter the Sweepstakes on behalf of their company.
(2) By Mail: To enter without purchase or obligation and receive one entry: Mail a 3 x 5 card hand-printed with name, daytime phone number, address, and business name to “2008 Summer of Savings Headquarters, 3200 Greenfield, Suite #280, Dearborn, MI 48120”. Entries must be postmarked by September 30, 2008. Only one entry per stamped envelope will be accepted. Enter up to ten times during qualifying period I and ten times during qualifying period II, not to exceed (20) entries during the promotion. No mechanical reproductions permitted. Entries become the property of Sponsor and will not be returned.
Drawing: Administrator is an independent judging organization whose decisions as to the administration and operation of the Sweepstakes and the selection of the potential winners are final and binding in all matters related to the Sweepstakes. Administrator will hold two drawings to randomly select the potential Sweepstakes winners from all eligible entries received during the Promotion Period. The first drawing will be held on or about July 8, 2008, for all the entries received through June 30, 2008 during the Qualifying I period. The second drawing will be held on or about October 8, 2008, for all entries received through September 30, 2008, during the Qualifying II Period. Each potential winner will be notified by mail, email or phone. Each potential winner will be required to sign and return to Sponsor, within five (5) days of the date notice or attempted notice is sent, an Affidavit of Eligibility, Liability & Publicity Release in order to claim his/her prize. If a potential winner cannot be contacted, or fails to sign and return the Affidavit of Eligibility, Liability & Publicity Release within the required time period, potential winner forfeits prize. Potential winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. Only three (3) alternate drawings will be held after which the prize will remain un-awarded. Only one prize per business.
QUALIFYING PERIOD I PRIZES:
ONE (1) FIRST PRIZE: Trip for two to the Motorcraft® Racing eventin Talladega AL,
on October 5, 2008. Trip package includes roundtrip coach-class air transportation
for two (2) from a major airport near winner’s home (determined by Sponsor at its
sole discretion); two (2) night accommodations at a hotel determined by Sponsor
at its sole discretion (single room, double occupancy); ground transportation to
and from the airport and hotel and to and from the Motorcraft® Racing event; and
meals to include (2) breakfasts, (2) lunches, and (2) dinners per guest; and two
(2) tickets to attend the Motorcraft® Racing event to be held October 5, 2008 in
Talladega, ALWinner must be available to travel between October 4, 2008, and October
6, 2008, or prize will be forfeited. Winner’s independent auto repair, collision,
or auto body facilities’ business name will appear on a decal on the #21 Motorcraft®
Fusion during the Motorcraft® Racing eventin Talladega, AL, on October 5, 2008. Placement of business name on vehicle to be determined in order of winner preference and based on availability. Placement options on the car include, and are not limited to, the following: hood, c-pillar, or deck lid. Sponsor and owner of business must approve use of name. In the event that Sponsor does not approve the use of the business name or if the name of the business is not able to be displayed on the car during the race, Sponsor in its sole discretion may award a cash substitute ($200 value) in lieu of placement of the business name on the #21 Motorcraft® Fusion. Approximate Retail Value (“ARV”): $2,780.00
FOUR (4) SECOND PRIZES: Trips for two to the Motorcraft® Racing event in Talladega,
AL, October 5, 2008. Trip package includes roundtrip coach-class air transportation
for two (2) from a major airport near winner’s home (determined by Sponsor in its
sole discretion); two (2) night accommodations at a hotel determined by Sponsor
in its sole discretion (single room, double occupancy); ground transportation to
and from the airport and hotel and to and from the Motorcraft® Racing event ; and
meals to include (2) breakfasts, (2) lunches, and (2) dinners per guest; and two
(2) tickets to attend the Motorcraft® Racing event to be held October 5, 2008, in
Talladega, AL Winner must be available to travel between October 4, 2008, and October 6, 2008, or prize will be forfeited. Approximate Retail Value (“ARV”): $2,580.00
FIVE (5) THIRD PRIZES: Trips for two to the Motorcraft® Racing event inBristol TN, on August 23, 2008. Trip package includes roundtrip coach-class air transportation for two (2) from a major airport near winner’s home (determined by Sponsor in its sole discretion); two (2) night accommodations at a hotel determined by Sponsor in its sole discretion (single room, double occupancy); ground transportation to and from the airport and hotel and to and from the Motorcraft® Racing event; and
meals to include (2) breakfasts, (2) lunches, and (2) dinners per guest; and two
(2) tickets to attend the Motorcraft® Racing event to be held August 23, 2008, in
Bristol, TN.
Winner must be available to travel between August 22, 2008, and August 24, 2008, or prize will be forfeited. Approximate Retail Value (“ARV”): $2,580.00
TEN (10) FOURTH PRIZES: Trips for two/Shop tour to Wood Brothers Racing in Charlotte, NC, on December 4, 2008. Trip package includes roundtrip coach-class air transportation for two (2) from a major airport near winner’s home (determined by Sponsor in its sole discretion); two (2) days and one (1) night accommodations at a hotel determined by Sponsor in its sole discretion (single room, double occupancy); ground transportation to and from the airport and hotel; and a VIP tour for two (2) of the Wood Brothers Racing Shop. Winner must be available to travel between December 2, 2008, and December 5, 2008 or prize will be forfeited. Approximate Retail Value (“ARV”): $1,280.
QUALIFYING PERIOD II PRIZES:
ELEVEN (11) FOURTH PRIZES: Trips for two/Shop tour to Wood Brothers Racing in Charlotte, NC, on December 4, 2008. Trip package includes roundtrip coach-class air transportation for two (2) from a major airport near winner’s home (determined by Sponsor in its sole discretion) to Charlotte, NC; two (2) days and one (1) night accommodations at a hotel determined by Sponsor in its sole discretion (single room, double occupancy); ground transportation to and from the airport and hotel; and a VIP tour for two (2) of the Wood Brothers Racing Shop. Winner must be available to travel between December 2, 2008, and December 5, 2008 or prize will be forfeited. Approximate Retail Value (“ARV”): $1,280.
ONE (1) FIFTH PRIZE: (1) Trip for two to Ford Championship Weekend at Homestead-Miami Speedway, FL, plus your business name on the #21 Motorcraft® Fusion during the race. Trip package includes roundtrip coach-class air transportation for two (2) from a major airport near winner’s home (determined by Sponsor in its sole discretion); three (2) night accommodations at a hotel determined by Sponsor in its sole discretion (single room, double occupancy); ground transportation to and from the airport and hotel and to and from the Homestead-Miami Speedway; and meals to include (2) breakfasts, (2) lunches, and (2) dinners per guest; and two (2) tickets to attend the Ford 400 race to be held November 16, 2008, at Homestead-Miami Speedway during Ford Championship Weekend (seat locations to be determined by Sponsor in its sole discretion). Winner must be available to travel between November 14, 2008, and November 17, 2008, or prize will be forfeited.
Winner’s independent auto repair, collision, or auto body facilities’ business name will appear on a decal on the #21 Motorcraft® Fusion during the Ford 400 at Homestead-Miami Speedway, FL, on November 16, 2008. Placement of business name on vehicle to be determined in order of winner preference and based on availability. Placement options on the car include, and are not limited to, the following: hood, c-pillar, or deck lid. Sponsor and owner of business must approve use of name. In the event that Sponsor does not approve the use of the business name or if the name of the business is not able to be displayed on the car during the race, Sponsor in its sole discretion may award a cash substitute ($200 value) in lieu of placement of the business name on the #21 Motorcraft® Fusion. Approximate Retail Value (“ARV”): $5,700
FOUR (4) SIXTH PRIZES: Trip for two to Ford Championship Weekend at Homestead-Miami Speedway, FL. Trip package includes roundtrip coach-class air transportation for two (2) from a major airport near winner’s home (determined by Sponsor in its sole discretion); three (2) night accommodations at a hotel determined by Sponsor in its sole discretion (single room, double occupancy); ground transportation to and from the airport and hotel and to and from the Homestead-Miami Speedway; and meals to include (2) breakfasts, (2) lunches, and (2) dinners per guest; and two (2) tickets to attend the Ford 400 race to be held November 16, 2008, at Homestead-Miami Speedway during Ford Championship Weekend (seat locations to be determined by Sponsor in its sole discretion). Winner must be available to travel between November 14, 2008, and November 17, 2008, or prize will be forfeited.
FOR ALL PRIZES: Trip must be booked at least twenty-one (21) days prior to departure. Trip subject to availability and blackout dates. Travel must be roundtrip. Sponsor will determine airline and flight itinerary in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel and accommodations are subject to availability. Travel is subject to the terms and conditions set forth in this Sweepstakes, and those set forth by the Sponsor’s airline carrier of choice as detailed in the passenger ticket contract. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation, meals, incidentals, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of winner. Travel companion must be eighteen (18) years of age or older as of the date of departure and must travel on same itinerary and at the same time as the winner. Travel companion must execute liability/publicity releases prior to issuance of travel documents. Travel restrictions, conditions and limitations may apply. If in the judgment of Sponsor air travel is not required due to winner’s proximity to prize location, ground transportation will be substituted for roundtrip air travel at Sponsors’ sole discretion. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Actual prize values may vary based on airfare fluctuations and distance between departure and destination. Sponsor is not responsible if any race or event is delayed, postponed or cancelled for any reason, in which event that portion of prize is forfeited in its entirety and no substitution will be provided except as in Sponsor’s sole discretion.
Prize is non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winner is responsible for all taxes and fees associated with prize receipt and/or use. The owner of the business will receive prizes and 1099 when applicable. Odds of winning a prize depend on the number of eligible entries received during the Promotion Period. Limit: One (1) prize per business. TOTAL APPROXIMATE RETAIL VALUE (“ARV”) OF ALL PRIZES: $80,580
Release: By receipt of any prize, winner agrees to release and hold harmless Sponsor, Administrator, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of any prize.
Publicity: Except where prohibited, participation in the Sweepstakes constitutes winner’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.
General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor at its sole discretion. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other Promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law; and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, provided that if it is not possible to award another entry due to discontinuance of the Sweepstakes, or any part of it, for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.
Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan (Southern Division) or the appropriate Michigan State Court located in Oakland County, Michigan; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Michigan without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan.
Privacy: Entrant's Personal Information: Information collected from entrants is subject to the Sponsor’s Privacy Policy available at http://www.fordvehicles.com/help/privacy/.
Winner List: For a list of winners send a hand-printed, self-addressed, stamped envelope to “2008 Summer of Savings” c/o PCGCampbell, 3200 Greenfield, Dearborn, MI 48120. Requests must be received by January 31, 2009.
Name Removal Notification System: If you would like your name removed from Sponsor’s mailing list, email INFO@2008SUMMEROFSAVINGS.COM [subject: Unsubscribe] and your name will be removed within 60 days of the request.
